AiMCO Member Agreement
Terms and conditions
This Membership Agreement (Agreement) is enacted when the applicant signs the membership form, pays the required fees and is accepted by the Australian Influencer Marketing Council (AiMCO) and the Audited Media Association of Australia (AMAA), constitutes a binding contract between AiMCO and the individual or entity executing the signature page of this Agreement (the Member).
AiMCO is registered under the AMAA (ACN 163 161 402) which is a Company Limited by a Guarantee.
As a Member of AiMCO, you agree to abide by the Constitution, Regulation and Reporting Standards that govern and regulate the AMAA, as well as these terms of membership under this Agreement.
All Members are required to indicate that they accept all terms and conditions of membership. New applications and renewals will not be processed until confirmation is received.

Membership application
Eligibility for members is subject to our receipt of your completed Membership Application Form and payment of the membership fee. You are required to provide true and correct information. AiMCO memberships are non-refundable, are individual to Members and non-transferable.
If AiMCO incurs any unexpected costs in processing membership fees, those costs will be charged back to that Member. Costs may include but are not limited to bounced fees and related bank charges.
Membership renewal
AiMCO membership must be renewed every 12 months. Existing members will receive an invoice for the subsequent 12 month period, 1 month prior to the renewal date. AiMCO membership is subject to payment of the membership fees and ongoing compliance with the applicable terms of membership. If a member does not renew/pay their membership fees, their membership will lapse and they will not have access to any membership benefits.
Refund of Membership Fees
Membership fees are not refundable, unless membership is declined by AiMCO; or in other exceptional circumstances determined by AiMCO at its discretion.
Membership Benefits
Any and all membership privileges, benefits and qualifications (detailed in Appendix 1), obtained through membership and this Agreement may be revoked or changed at any time with prior notice to members.
The Member agrees that they meet all membership requirements as laid down in this Agreement and the AMAA Constitution, Regulation and Reporting Standards. Members must notify AiMCO if any requirements are not met during the time of the Agreement term or their status changes.
Member information will be documented as below but may be updated or changed at any point of the Agreement term.
Membership Lapse, Resignation or Termination
If membership does lapse, is resigned or terminated, the Member must remove all reference and association to AiMCO from their website and any sales or marketing collateral. The Member must stop making any claim of membership or using the AiMCO logo.
Use of AiMCO Logo, name, claims and marketing
Only current Members can claim membership to AiMCO including use of the AiMCO logo and its marketing collateral.
Only AiMCO approved claims can be made. Please contact AiMCO via email info@aimco.org.au for the member pack and approved claims.
Misleading statements
A Member must not, either expressly or by implication, make inaccurate or misleading statements relating to AiMCO or the AMAA.
Material reproduced from documents released by AiMCO must not be reproduced out of context and must convey the same meaning as it did in the original document.
Access to AiMCO 'Member Only' sections of the website
AiMCO members will have access to the members only sections of the AiMCO website (when available).
Privacy about the data AiMCO collects about you and your company
By becoming a member of AiMCO you will provide data about yourself and your company. AiMCO Member data is not for sale, barter or trade with any Member or any external business or association. Some information may be used to promote your membership through the website and in AiMCO marketing collateral and will be detailed in the membership application, or requested separately.
Information collected for participation at events, webinars may be shared with third parties hosting or supporting these events, with opt-out options. Liability
AiMCO, AMAA and associated agencies and companies exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law, for any direct or indirect injury, loss and/or damage to Members arising in any way out of membership. This includes, but is not limited to: (i) any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, AIMCo membership; and/or
(ii) acceptance and/or use of any information or materials.
The liability of each members in limited. Each member guarantees to contribute up to a maximum of one dollar ($1.00) to the assets of the company if it is wound up while he or she is a member, or within one year afterwards, and at the time of winding up the debts and liabilities of the company exceed its assets. The liability of each members is limited to making such contribution and no more.
Indemnity
To the extent permitted by law, each member indemnifies, and must defend and hold harmless, AiMCO, the AAMA and their employees, servants, agents and contractors, from and against all losses arising from:
(i) a breach by a member of any terms of membership or this Agreement; or
(ii) any third party claim arising directly or indirectly from a breach by the Member of any terms of membership.
Changes to this Membership Agreement
From time to time it may be necessary for us to review this policy. We reserve the right to amend this policy at any time and to notify you of any amendments by posting an updated version on our website www.aimco.org.au.
